This page explains donation designations, acknowledgments, restrictions, complex gifts, and donor privacy.
1. Charitable status
Embajadores International Foundation, Inc. is recognized as exempt under Internal Revenue Code section 501(c)(3) and classified as a public charity under section 170(b)(1)(A)(vi). Tax deductibility depends on applicable law and the donor’s circumstances.
2. Gift use
Unrestricted gifts may be used where needed most to advance approved charitable purposes. Restricted gifts are accepted only when the restriction is consistent with the mission, authorized programs, law, budget, capacity, and gift-acceptance standards.
3. Designations
Unless otherwise stated in an authorized campaign or written gift agreement, donations are accepted for use where needed most. A designation for Staying Connected Network or another approved purpose may be accepted only when the Foundation has authorized that designation and can administer, track, and report the gift appropriately. The Foundation may decline or modify a requested restriction that is inconsistent with its mission, legal obligations, approved programs, or administrative capacity.
4. Acknowledgments
The Foundation will provide receipts and legally required acknowledgments. For contributions of $250 or more, acknowledgments will include required information concerning the amount or description of the gift and whether goods or services were provided. Quid pro quo transactions will include required value information when applicable.
5. Noncash and complex gifts
Securities, real estate, vehicles, cryptocurrency, intellectual property, closely held interests, planned gifts, restricted gifts, and other noncash or complex gifts require advance review. The Foundation may seek professional advice and may decline gifts that create unacceptable obligations, costs, risk, restrictions, or mission conflict.
6. Valuation and tax advice
The Foundation generally does not determine a donor’s tax deduction or provide legal, tax, appraisal, or financial advice. Donors are responsible for obtaining independent advice and required appraisals or filings.
7. Refunds and reversals
Completed charitable gifts are generally final. The Foundation may review documented errors, unauthorized transactions, duplicate processing, legal requirements, or other exceptional circumstances. Event purchases and sponsorships may have separate terms.
8. Donor privacy
Donor information is used for processing, acknowledgment, accountability, accounting, compliance, and authorized communications. The Foundation does not sell donor information. Recognition preferences will be respected when practicable, subject to legal and audit requirements.
